ACLU’s Duncan Case Dismissed

Today we finally have some exciting news: just a few short hours ago our office received word from the Attorney General that the ACLU’s Duncan case against Nevada’s ESA program was dismissed, for lack of any legal merit. This is a major victory for educational choice in Nevada. Our office remains committed to implementing the most expansive and best educational choice program in the nation. I want to remind all families that while today’s outcome is exciting, an injunction still remains in the Lopez case that is currently waiting on Supreme Court action. Below you will find the statement Treasurer Schwartz released just moments ago.

TREASURER DAN SCHWARTZ PLEASED WITH TODAY’S ESA RULING

Carson City, NV – Responding to today’s ruling in Duncan v. Schwartz by District Court Judge Eric Johnson, State Treasurer Dan Schwartz issued the following statement:

“We are pleased with Judge Johnson’s well-considered decision to uphold the constitutionality of Nevada’s Education Savings Account program. While the program remains under an injunction issued in Lopez v. Schwartz, today’s ruling brings us one step closer to allowing Nevadan parents educational choice opportunities for the upcoming school year. We look forward to the Nevada Supreme Court’s final decision.”

Our office has received an estimated 6,000 plus applications throughout the past year. All applications received during the enrollment period were date stamped, and will be processed promptly if the injunction is lifted.
